Welcome to Glutenful. The terms “Glutenful,” “we,” “us,” and “our” refer to Glutenful, located at 21800 Oxnard Street, Suite 250, Woodland Hills, CA 91367, United States.
These Terms of Service, together with our Privacy Policy, Shipping Policy, Refund Policy, Accessibility Statement, and any other policies posted on our website, govern your access to and use of our website, online store, products, content, features, tools, and services.
By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, do not use our website or purchase our products.
1. ELIGIBILITY AND ACCOUNT USE
You must be at least the age of majority in your state of residence to use our services or purchase products from us. If you permit a minor to use our website through your account or device, you are responsible for that use.
You agree to provide accurate, current, and complete account, billing, payment, and shipping information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. OUR PRODUCTS, GLUTEN, AND ALLERGENS
Glutenful products are intentionally not gluten-free. Our products contain wheat and gluten and are not suitable for people with celiac disease, wheat allergy, gluten intolerance, or anyone medically advised to avoid gluten.
Allergen Warning: Our products contain or may come into contact with major food allergens, including wheat, milk, eggs, soy, peanuts, tree nuts, and sesame. Some products may also be manufactured, stored, or packaged in facilities that process other allergens. Always review the ingredient list, allergen statement, and product packaging before purchase and consumption.
You are responsible for determining whether a product is safe for you or anyone you provide it to. Any nutrition, ingredient, dietary, or health-related information on our website is provided for general informational purposes only and is not medical advice.
Nothing in these Terms limits liability for our own negligence, willful misconduct, product mislabeling, violation of applicable food safety laws, or any liability that cannot legally be limited or excluded.
3. PRODUCT INFORMATION
We try to present product information accurately, but packaging, ingredients, nutrition facts, availability, prices, colors, and product appearance may change without notice. Your device display may not accurately show product colors, packaging, or appearance.
If there is a conflict between website information and the physical product label, the physical product label controls, except where prohibited by law.
4. ORDERS, ACCEPTANCE, AND CANCELLATIONS
Placing an order is an offer to purchase. We may accept, decline, cancel, or limit any order for any lawful reason, including suspected fraud, pricing errors, inventory issues, shipping restrictions, or misuse of promotions.
Your order is not accepted until we confirm acceptance. Because we fulfill orders quickly, we may be unable to modify or cancel an order once it is submitted.
If we cancel an order after payment, we will issue a refund for the canceled portion of the order in accordance with applicable law.
5. PRICES, PAYMENT, AND TAXES
Prices, discounts, promotions, taxes, shipping charges, and availability may change without notice. The price charged will be the price shown at checkout, subject to correction of obvious errors.
You represent that you are authorized to use the payment method provided and agree to pay all charges, including applicable taxes, shipping, and handling.
6. SHIPPING, DELIVERY, AND PERISHABLE GOODS
We ship perishable baked goods using third-party carriers such as UPS. Shipping and delivery dates are estimates unless expressly stated otherwise.
We will make commercially reasonable efforts to ship within the timeframe stated at checkout or in our Shipping Policy. If we cannot ship within the promised timeframe, we will provide notice and any cancellation or refund rights required by applicable law.
Once an order is delivered to the address provided at checkout, you are responsible for retrieving and properly storing the product. We are not responsible for spoilage, melting, degradation, theft, damage, or quality issues caused by incorrect addresses, missed deliveries, unattended packages, weather exposure, carrier delays, or failure to retrieve and store products promptly after delivery, except where required by law.
Title and risk of loss pass to you when the product is delivered to the shipping address you provided, except where applicable law requires otherwise.
7. RETURNS, REFUNDS, AND FOOD SAFETY
Because our products are perishable consumable food items, all food sales are final. We cannot accept physical returns of food products once they have left our control.
This does not limit your rights under applicable law. We may provide a replacement, store credit, or refund if an order arrives damaged, defective, incorrect, missing items, subject to a recall, or otherwise required to be remedied by law.
To request help with an order issue, contact us at eat@glutenful.com within 48 hours of delivery and include your order number, photos of the product and packaging, and a description of the issue.
8. PRIVACY AND CALIFORNIA RIGHTS
Our collection and use of personal information is governed by our Privacy Policy. If you are a California resident, you may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including rights to know, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and not be discriminated against for exercising your rights.
If we use advertising, analytics, retargeting, pixels, cookies, or similar technologies that constitute a “sale” or “sharing” of personal information under California law, we will provide a “Do Not Sell or Share My Personal Information” mechanism and honor valid Global Privacy Control signals where required by law.
These Terms do not replace our Privacy Policy or Notice at Collection. Please review those documents for details about the categories of personal information we collect, sources, purposes, disclosures, retention, and your rights.
9. ACCESSIBILITY
We are committed to making our website accessible and usable for all customers. If you experience difficulty accessing any part of our website, contact us at eat@glutenful.com and we will work with you to provide the information, product, or service you need through an accessible method.
We welcome accessibility feedback and treat accessibility as an ongoing operational commitment, not a one-time statement.
10. INTELLECTUAL PROPERTY
Our website, content, trademarks, names, logos, slogans, product names, graphics, designs, photos, videos, text, and other materials are owned by Glutenful or our licensors and are protected by intellectual property laws.
You may use our website for personal, non-commercial shopping purposes only. You may not copy, reproduce, distribute, scrape, modify, sell, exploit, or create derivative works from our content without our prior written permission.
11. REVIEWS, FEEDBACK, AND USER CONTENT
If you submit reviews, photos, comments, ideas, feedback, or other content to us, you grant Glutenful a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, edit, display, distribute, and create derivative works from that content for any lawful purpose, including marketing.
You represent that you own or have permission to submit the content, that it is accurate, and that it does not violate any law or third-party rights. We may remove or refuse content at our discretion.
12. THIRD-PARTY SERVICES
Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, analytics providers, advertising platforms, review tools, and embedded features. We are not responsible for third-party websites, services, content, policies, or practices.
Purchases from Glutenful are made directly with Glutenful. Shopify provides technology that helps power our store but is not responsible for Glutenful products, fulfillment, food safety, customer service, or order issues.
13. PROHIBITED USES
You may not use our website or services for unlawful, fraudulent, abusive, harmful, infringing, harassing, misleading, spam-related, automated scraping, security-circumvention, or unauthorized commercial purposes.
You may not use bots, scrapers, crawlers, AI agents, automated tools, or similar technologies to access, copy, monitor, purchase from, test, or interact with our website in a manner that burdens, harms, bypasses, or exploits our systems or violates these Terms.
14. DISCLAIMER OF WARRANTIES
Except as expressly stated by Glutenful or required by law, our website, services, and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted service, accuracy, or availability.
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Glutenful and its owners, officers, employees, contractors, suppliers, service providers, affiliates, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including lost profits, lost revenue, lost data, or replacement costs, arising out of or related to your use of our website, services, or products.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to an order will not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, fraud, personal injury caused by our negligence, product liability that cannot be waived, violation of applicable food safety laws, or rights you may have under consumer protection laws.
16. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Glutenful and its owners, officers, employees, contractors, suppliers, service providers, affiliates, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, misuse of our services, violation of law, infringement of third-party rights, or content you submit.
17. DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER
Please read this section carefully. It affects your legal rights.
Before filing a claim, you agree to contact us at eat@glutenful.com and attempt to resolve the dispute informally. Your notice must include your name, order number if applicable, contact information, a description of the dispute, and the relief requested.
If we cannot resolve the dispute informally within 30 days, either party may bring an individual claim in small claims court in Los Angeles County, California, if eligible, or submit the dispute to binding individual arbitration administered by the American Arbitration Association under its applicable consumer arbitration rules.
You and Glutenful waive the right to a jury trial and agree that disputes will be resolved only on an individual basis. Neither party may bring or participate in a class action, class arbitration, private attorney general action, consolidated action, or representative action, except where this waiver is prohibited by law.
You may opt out of this arbitration section by emailing eat@glutenful.com within 30 days after first agreeing to these Terms. Your opt-out notice must include your name, email address, and a clear statement that you opt out of arbitration.
18. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to the arbitration section above, you and Glutenful consent to exclusive jurisdiction and venue in the state and federal courts located in Los Angeles County, California.
19. TERMINATION
We may suspend or terminate your access to our website or services at any time if we believe you have violated these Terms, created risk for Glutenful or others, or engaged in unlawful, fraudulent, abusive, or harmful conduct.
20. CHANGES TO THESE TERMS
We may update these Terms from time to time. The updated version will be posted on this page with the updated effective date. Continued use of our website or services after changes become effective means you accept the updated Terms.
21. SEVERABILITY; WAIVER; ENTIRE AGREEMENT
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms and the policies referenced in them are the entire agreement between you and Glutenful regarding your use of our website and services.
